Today we applaud the Legal Aid SA Middelburg Local Office, and a matter handled by Criminal Supervisory Legal Practitioner Rudzani Mafumela.BACKGROUND- Our client was charged with shoplifting. - It was alleged that he had stolen tin foil valued at R180 from a supermarket. - It was further alleged that the client had swopped more expensive tin foil with a cheaper one and proceeded to pay the lower price for the more expensive item. - This was all caught on CCTV.WHAT HAPPENED IN COURT?- Rudzani argued that the client did not commit theft even if the State was able to prove that he switched the items in order to pay a lower amount. - The correct charge should have been fraud.
