  • B Proc or LLB.

  • At least seven years’ post-admission legal experience.
  • Experience as a Senior Legal Practitioner or equivalent preferable.
  • Legal Quality Assurance score of not less than 90%.

PURPOSE:

To provide an effective executive secretarial and administrative support service to the Office of the Executive.

KEY OUTPUTS AND ACCOUNTABILITIES:

  • Arrange meetings, conferences, workshops, interviews, et cetera, according to priority.
  • Scheduling/rescheduling of appointments and meetings correctly and timeously.
  • Synchronisation between electronic and manual diaries.
  • Prepare accurate and updated diary and follow-up system at all times to ensure proper access control to the Executive.
  • Confirm venue and catering arrangements prior to the event.
  • Keep accurate records of all messages taken for the attention of the Executive.
  • Ensure that the office of the Executive and own workstation is kept clean and neat at all times.
  • Maintain good relations with all internal and external customers/stakeholders.
  • Effectively communicate with people at all levels on behalf of the Executive as per the instruction or in the execution of duties.
  • Arrange events and functions in accordance with company procedures.
  • Compile agenda, previous minutes, reports and relevant documentation accurately in accordance with the Executive’s requirements.
  • Accurately inform all concerned per e-mail of meeting date, time and venue.
  • Distribute documentation seven (7) days prior to the meeting.
  • Confirm attendance one day prior to the meeting.
  • Oversee printing/copying and binding of meeting packs in the required format and process electronic documentation in line with Legal Aid SA administrative procedures.
  • Ensure that documents distributed internally or externally are of a high standard
  • Handle incoming and outgoing mail as per the instructions and in accordance with Legal Aid SA administrative procedures.
  • Ensure that all contracts are finalised in terms of the Legal Aid SA Approval Framework.
  • Keep records as per legal requirements and file documents 100% correctly according to Filing Index System.
  • Complete travel arrangements for the Internal Audit Executive and other staff within the requirements and deadlines according to financial and procurement procedures, with no double or incorrect bookings.
  • Complete Executive expense claims 100% within company policies and procedures.
  • Type assignments for completion within agreed time frames, perform spell checks on all documents and treat them as confidential.
  • Attend to visitors with caution and promptly according to protocol on receiving guests and as per scheduled appointments. Make discretionary decisions when managing difficult clients.
  • Arrange secure parking for visitors according to Legal Aid SA security policies and procedures.
  • Comply 100% with Client Service Standards Charter by ensuring that customer needs are identified quickly and correctly, they are provided with correct information and directed to a person who can assist them. Customers are made to feel at ease.
  • Refer all internal and external queries timeously to the relevant Manager/Executive and keep accurate records of customer complaints, referrals to relevant departments until finalisation.
  • Accurate maintenance of personnel records and keep leave records in the required format.
  • Conduct a bi-annual/annual audit of fixed assets to ensure that all assets are recorded and present.
  • Maintain fixed assets, tools and equipment, photocopy, fax, petrol card and vehicle key registers.
  • Comply with Legal Aid SA Procurement Regulations by ensuring payment of creditors in accordance with Legal Aid SA Financial Policy/Procedures and maintain Purchase Orders accurately as per set procedure.

COMPETENCIES (SKILLS, KNOWLEDGE AND ATTRIBUTES) REQUIRED

  • A recognised Grade 12 certificate with a Secretarial Diploma and a high level of proficiency in using MS Office Programmes.
  • Minimum 3 years of secretarial experience.

KEY OUTPUTS

  • Classify alleged incident into fraud, corruption, maladministration, employee misconduct and all other relevant breaches of laws/policies.
  • Reach an understanding with the client about the scope and limitations of the fraud examination and the responsibilities of all parties involved.
  • Determine the purpose, objective and determine the approach of an investigation.
  • Identify and interview relevant personnel that will be of assistance in an investigation and the alleged perpetrator.
  • Investigate allegations of irregularities including fraud in line with policies, procedures and legislation and/or in line with the department’s methodology.
  • Identify and request relevant documents and all exhibits and annexures to support the results of investigations including findings raised in the report.
  • Obtain evidence or other documentation to establish a reasonable basis for any opinion rendered. No opinion shall be expressed regarding the guilt or innocence of any person or party.
  • Shall not reveal any confidential information obtained during a professional engagement without proper authorisation.
  • Will reveal all material matters discovered during the course of an examination, which, if omitted, could cause a distortion of the facts.
  • Provide assistance in regard to disciplinary enquiries, as may be requested by Management.
  • Give evidence on behalf of Legal Aid SA in criminal and civil matters, when the need arises.
  • Provide an analysis of the impact assessment of fraud incidents and control environment.
  • Create and implement Legal Aid SA’s fraud awareness, promote ethics and prevention programmes internally through the different mediums.
  • Compilation of comprehensive draft reports on all investigated incidents, which should include findings and recommendations for review by a Forensic Audit Supervisor.
  • Compilation and maintenance of an Investigating Register and Forensic Findings Register.
  • Engage with relevant stakeholders during the investigation process, which includes internal and external staff, Management as well as SAPS.
  • Assist the Forensic Audit Supervisor with the quarterly performance reports to the Audit Committee and provide input into the Management and Board reports.
  • Follow up on the recommended course of actions not followed up to ascertain if they were implemented and the Investigations Register updated.
  • Assist the Forensic Audit Supervisor with the annual review of the Forensic Methodology, Standard Operating Procedures and other governance instruments.
  • Do not disclose confidential or privileged information obtained during the course of a fraud examination without the express permission of a proper authority (CEO) or the lawful order of a court. Uphold the Association of Certified Fraud Examiners, an association of professionals committed to performing at the highest level of ethical conduct. Members of the Association pledge themselves to act with integrity and to perform their work in a professional manner.

COMPETENCIES (SKILLS, KNOWLEDGE & ATTRIBUTES) REQUIRED

  • Three-year qualification with courses in Accounting, Auditing, Internal Auditing or Law. Membership of the Association of Certified Fraud Examiners will be advantageous.
  • A minimum of five (5) years experience in investigation/prosecution as well as giving evidence in court.
  • In-depth knowledge of forensic auditing and corporate governance disciplines and how to implement and leverage these within a complex business environment:
    1. Working knowledge of PFMA, POCA, POPI, RICA, National Treasury Regulations, Legal Aid SA Act and other relevant Statutes.
    2. Working knowledge of King IV Code of Corporate Governance.
    3. Functional ability in the utilisation of electronic internal auditing systems and technologies.
  • Investigation/prosecution experience and knowledge of court procedures and functions.
  • Knowledge of Regulatory Framework for Public Finance Management Act, Treasury Regulations, POCA, POPI, RICA and Public Service Act and Regulations.
  • Able to partner with Forensic Audit Supervisor, Internal Audit Executive and Management to support the achievement of strategic objectives through effective forensic auditing processes.
  • Business acumen and the ability to deal with ambiguity, meet demanding deadlines and manage projects.
  • Development of skills in at least one listed audit area, i.e., Data Analytics, Computer and Internal Audit.
  • Must possess a valid driver’s license and be willing to travel to other provinces.

POSITION PURPOSE

To conduct audit reviews and evaluations on internal controls, control self-assessments, risk management, corporate governance practises, adequacy and effectiveness of controls within Legal Aid SA and render related advice to management.

KEY OUTPUTS

  • Scheduling of all planning logistics for audit projects allocated.
  • Compiling of detailed audit programmes for all activities that form part of an audit under the supervision of the senior Internal Auditor.
  • Co-ordinate the execution of the audit programmes for specific audits.
  • Conducting entry and exit meetings during audits.
  • Drafting audit reports for review by the Internal Audit Supervisor in accordance with all SOPs.
  • Reviewing of all project working papers on TeamMate.
  • Identifying risks and ensuring that the supporting audit programme is risk-based.
  • Determine the sampling methodology to be used for the audit programme, as well as sample sizes.
  • Ensuring the maximum utilisation of IDEA and TeamMate software and resolving all troubleshooting issues.
  • Overseeing the quality of audit working papers and completion of all audit projects within the stipulated timeframes.
  • Ensuring the supervision of all fieldwork and that delivery challenges are resolved timeously.
  • Perform audit fieldwork for more complicated areas and documenting the audit evidence on TeamMate.
  • Discussion of more complex exceptions with the Auditee, involving system and legislative issues, and documentation of both exceptions and findings.
  • Identification of areas that require specialist intervention.
  • Conducting standard and governance audits including ad hoc and special projects.
  • Assisting the Internal Audit Supervisors as and when required, in compiling the Findings Register, Tracking Schedules, Heat Maps and Charts.
  • Conduct performance reviews of all subordinates.
  • Recommend leave and appropriate training for subordinates to the Internal Audit Supervisors.

COMPETENCIES (SKILLS, KNOWLEDGE AND ATTRIBUTES) REQUIRED

  • Three (3)-year qualification with courses in Accounting, Auditing, Internal Auditing or Management Accounting.
  • Membership of the Institute of Internal Auditors will be advantageous.
  • Minimum of three (3) years of internal audit work experience.

Invitation to be included on Legal Aid SA’s Recruitment Database

Legal Aid SA is the biggest law firm in South Africa, with 64 Local Offices and 64 Satellite Offices throughout the country. The organisation employs well over 1,700 lawyers. Legal Aid SA would like to invite recruitment agencies to be included on Legal Aid SA’s recruitment database.

Primarily, Legal Aid SA conducts its advertising through print media and via its website. Recruitment houses will only be used once these primary mediums are exhausted. Once on Legal Aid SA’s recruitment database, recruitment agencies will be used on a rotational basis. The database will be updated every three years.

Recruitment agencies are required to submit the following information when applying:

  • Indicate their speciality e.g. Legal, Human Resources, Finance, IT, Communications/Marketing and Audit.
  • Company profile depicting project experience, with a minimum of five (5) years experience in recruitment agency services.
  • A minimum of four (4) reference letters or completion certificates from previous/present clients where recruitment agency services were/are rendered. All letters must be on a letterhead and signed by the client. The client must be contactable and the contact details provided must include:
  • Contact person;
  • Designation;
  • Company name;
  • Phone number;
  • E-mail address; and
  • Landline and mobile number.
  • Capacity to deliver on all requirements as the terms of reference: Evidence of qualifications of individuals, number of skilled people to do the job and expertise (CVs, list of people and expertise).
  • Proof of registration on National Treasury’s Central Supplier Database (CSD) which should reflect that the bidder is an active supplier, is tax compliant and is not a restricted supplier.
